Donation Terms and Conditions

These terms govern every contribution made to the “CEMSIES in Action: Rise Anew” campaign through WhyDonate.
Article 1 — Campaign purpose and scope
This fundraising initiative is promoted by CEMS Club Bogotá and CEFA to support educational programs delivered by Rebel Business School Colombia.
Final beneficiary of the funds: MRD CONSULTORES S.A.S., commercially identified as Rebel Business School Colombia, NIT 900.408.297-8, domiciled at Avenida Cra 19 #100-45, Bogotá.
Payment platform: donations are processed through WhyDonate (whydonate.com), operated by WhyDonate B.V. (Netherlands), in EUR, COP and USD. The promoter never receives, holds or administers the funds.
Article 2 — Non-refundability and partial goal execution
All contributions made through this platform are final and non-refundable. In the event that the target goal of €20,000 is not fully reached, all collected funds will be applied proportionally to the same program, sponsoring as many beneficiary slots as the total amount raised permits.
Refunds will only be considered in cases of proven technical errors, duplicate charges, or duly proven unauthorized transactions. Such requests must be sent to the official campaign email within thirty (30) calendar days of the transaction and are also subject to WhyDonate and payment-issuer policies.
If fundraising exceeds the base target, the surplus is allocated to the published extended goals (additional cohorts of the same program). Net amounts may vary from donated amounts due to platform fees, bank fees and exchange rates.
Article 3 — Tax treatment disclaimer
Donations made through this campaign do not generate tax deductions, credits, or exemptions under Colombian tax law. No certificates of donation with fiscal or tax-deductible effects will be issued.
The beneficiary is not an entity qualified under the Special Tax Regime pursuant to Articles 19 and 257 of the Colombian Tax Statute. Donors who are tax residents elsewhere should verify any effects with their own advisor.
Article 4 — Role of student organizations and fund routing
CEMS Club Bogotá and CEFA participate strictly as good-faith promoters and advocates. They do not perform formal financial reviews, accounting oversight, or statutory reviews, nor functions reserved for public accountants under Law 43 of 1990.
All financial transactions and funds go directly to the bank account of Rebel Business School Colombia, which is exclusively responsible for executing the program.
Monitoring consists of requesting execution reports from the beneficiary and publishing them in the Transparency section, without constituting independent accounting verification or professional certification.
The campaign is not organized, administered or funded by any academic institution; the student link is limited to the personal academic background of the participating students.
Article 5 — Data protection and inquiries
Personal data collected during the donation process is handled in accordance with our Personal Data Processing Policy and Law 1581 of 2012. WhyDonate processes payment data under its own privacy policy and the EU GDPR.

These terms are governed by the laws of the Republic of Colombia; any dispute shall be submitted to the competent courts of Bogotá D.C.
